Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer does not
furnish employment and a place of employment which are free from
recognized hazards that
are causing or likely to cause death or physical harm to employees in that
employees are
exposed to struck by hazards:
a)This occurred on or about September 8, 2010, at the Seaboard Wellhead,
Inc. facility
at 13815 South Freeway, Houston Texas, when the employer did not ensure
employees unloading a 20 foot long freight container were provided with
and utilized
proper instructions and equipment to pull palletized equipment from the
container.
Three employees were exposed to being struck by material handling
equipment that
was overloaded when the pallet puller was used to move double stacked and
banded
crates to the rear of the container for removal by a forklift.
ABATEMENT NOTES: Among other methods, recognized and feasible means of
abatement to correct the hazard include but are not limited to:
1) Ensure that all slings, pallet pullers, chains  and other devices used
in material
handling are inspected and used within the equipments' rated capacity, and
ensure that
the device with the least rated capacity limits the use of the equipment
collectively to
that lowest rated capacity when used as one unit. Develop and implement
inspection
procedures to ensure devices including but not limited to slings, chains
and pallet
pullers are in safe operating condition.
2) Develop and implement a written operating procedure to ensure employees
involved in material handling understand assigned roles, safe positioning,
and hazards
associated with the process of unloading containers, including the
struck-by hazards
resulting from the snapback or recoil of slings, chains and equipment
under load.
3) Develop and implement safer, alternative methods of removal of
palletized cargo
from containers when such methods are feasible, develop operating
procedures for
these alternative methods, and ensure equipment, including loading ramps
and dock
plates, are provided.

Pursuant to 29 CFR 1903.19, within (10) Calendar days of the abatement
date of this
citation, the employer must submit documentation demonstrating the steps
being taken
to ensure that equipment capacities are not exceeded, inspections of
equipment are
conducted, procedures are in place that keep employees out of snapback or
recoil
areas during unloading, and alternative methods, such as loading ramps and
dock
plates are available for use and used when feasible.

employer does not

causing or likely to cause death or serious physical harm to employees in
that employees are
exposed to struck-by hazards:
a)The employer does not ensure that employees utilize a floor mounted jib
crane to hoist
loads that are within the rated load limits of the hoist. This occurred on
October 29,
2010, when jib crane JC11 (not marked with the manufacturer or serial #),
with a rated
load capacity of 500 lbs, was used with a Dayton hoist, model, HHXG12,
serial #
4GU71 with a rated capacity of 500 lbs, to hoist a frac adapter 909879RNT,
weighing
968 pounds. This lift overloaded the hoist, exposing employees to struck
by hazards.
b)The employer does not ensure that hoists are inspected frequently and
periodically. This
occurred on October 21, 2010, resulting in hoists being used with hook
safety latches
missing, and hoist pendant stations that were not legibly marked. These
conditions
exposed employees to struck-by hazards.

ABATEMENT NOTES: Among other methods, one feasible method of abatement to
reduce this hazard is to ensure loads do not exceed the rated load of
hoisting equipment
as outlined in the American Society of Mechanical Engineers, ASME
B30.16-1998
Section 16-3.2.1 which indicates that a hoist shall not be loaded in
excess of its rated
load except for test purposes as provided by paragraph 16-2.2.2 or for
planned
engineered lifts as provided in paragraph 16.3.2.2, and to inspect cranes
and hoists
frequently and periodically, as outlined in the American Society of
Mechanical
Engineers, ASME B30.16-1998 Section 16-2.1.b Inspection Procedures for
hoist in
regular service. 16-2.1.2 Frequent inspections shall be performed at
intervals defined in
16-2.1.1 (daily, weekly and monthly). Section 16-2.1.3 states that
periodic inspection
shall be performed at intervals defined in paragraph 16-2.1.1(b)(2) -
yearly for a crane
in normal service.
c)The employer does not ensure that floor mounted jib cranes used to hoist
loads are used
within the rated load capacity of the crane. This occurred on October 21,
2010, when jib
crane JC11, with a rated load capacity of 500 lbs, was used with a Coffing
hoist, with
a rated capacity of 1,000 pounds to hoist a dual actuator, part number
903515, weighing
852 pounds. This lift overloaded the crane, exposing employees to struck
by hazards.
d)The employer does not ensure that cranes are inspected frequently and
periodically. This
occurred on October 21, 2010, resulting in cranes being used that were not
marked with
rated capacity. This condition exposed employees to struck-by hazards.
