Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential struck-by hazards from loads handled by the JET model RS electric chain hoist. On or about January 12, 2011, it was observed that the employer had welded a 3/8" bolt and nut onto the hook of the 1-ton jib crane, equipped with a JET model RS Series electric chain hoist. The crane, located near the heads department, was used to move engine parts weighing between 40 and 250 pounds. The hoist had not been inspected frequently or periodically. The hook had not been heat treated nor load tested after welding and grinding. These conditions exposed employees to struck-by hazards. Among other methods, feasible abatement methods to correct this hazard include: 1) Follow the inspection and maintenance requirements as outlined in ASME B30.10-2009 "Safety Standards for Cableways, Cranes, Hoists, Hooks, Jacks, and Slings" Section 10-1.3, which states that attachments, such as handles, latch supports, etc. shall not be welded to a finished hook in field applications. If welding of an attachment such as these is required, it shall be done in manufacturing or fabrication prior to final heat treatment. Inspect hooks as outlined in ASME B30.10-2009 Section 10.2.3(c). These sections require that hooks with the following conditions be removed from service until repaired: Section 10.1.2.3 (c) A hook latch, when required, that is inoperative shall be replaced or repaired; and Section 10.1.2.3 (d) A hook with a latch that does not close the throat opening shall be removed from service or moused until the latch is replaced or repaired. 2) Follow safety warnings contained in the updated owner's manual for electric chain hoists, which stated that the load chain and hook must not be allowed to be contacted by a live welding electrode. The warnings also state that a chain hoist must not be utilized when a hook is stretched, deformed, damaged, or has a borken or missing safety latch. The latch and/or hook must be replaced before placing the chain hoist back into service. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation.
