Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and/or crushing hazards when the employer did not furnish chock blocks to the drivers for them to use as instructed to in the owners manual. On our about April 22, 2011, at the construction site in the vicinity of Hwy 288 and N. MacGregor Way, Houston Texas 77021, the operator of a International concrete truck, VIN number 1HTXLAHTX5J132102 equipped with a WTEC III Allison transmission, did not utilize wheel chocks when he exited the vehicle with the engine running to operate the remote throttle, exposing the employee to struck-by hazards. Among other methods, one feasible and acceptable abatement method is to read and comply with the warning in the Allison operator's manual, which states: "WARNING: If you leave the vehicle and the engine is running, the vehicle can move suddenly and you or others could be injured. If you must leave the engine running, do not leave the vehicle until you have completed all of the following procedures: -Put the transmission in N (Neutral) -Ensure engine is at low idle -Apply the parking brake and emergency brakes and make sure they are properly engaged. -Chock the wheels and take any other steps necessary to keep the vehicle from moving."
