Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of the rotating blade(s): (a) Main Shop, North End, Vertical Band Saw Area - provisions were not made to prevent the Do All vertical band saw, Model Number 36-3, Serial Number 5354131, from restarting upon restoration of electrical power after a power source failure. The saw was last used on or about January 31, 2009. Among other methods, one feasible and acceptable means of abatement in event of interruption in the electrical supply to the Do All vertical band saw would be to provide an electrical device that it is designed to prevent the saws from restarting automatically when power is restored, such as a magnetic re-starter or similar device as prescribed by the American National Standard Institute for Metal Cutting Sawing Machines, ANSI B11.10-2003, Section 6.11 and the National Fire Protection Association for Electrical Standard for Industry Machinery 79-2007, Section 7.5.3. In accordance with 29 CFR 29 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
