Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of crushed-by and falling: (a)On or about 02/20/09 - 201 Office Park Road, Mountain Brook, AL, the safety interlocks of a Genie AWP-36S were by-passed. (b)On or about 02/20/09 - 201 Office Park Road, Mountain Brook, AL, the occupancy rated load of a Genie AWP-36S was exceeded. (c)On or about 02/20/09 - 201 Office Park Road, Mountain Brook, AL, the aerial platform of a Genie AWP-36S was operated with only three of the four outriggers installed on unstable soft surface creating a tipover hazard. Among other methods, one feasible and acceptable method to correct this hazard would be to follow the Genie AWP Super Series Operators Manual, Second Edition: Second Printing, April 2004.
