Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to injuries and possible burns: On or about February 19, 2009, and at other times prior thereto, at this establishment, 3652 Nueces County Jail, Corpus Christi, Texas, employees were tasked to manually lift and transport 5-gallon insulated coffee containers. The containers were filled with coffee heated to approximately 150 degrees fahrenheit. The lids to the containers could not be fastened due to the latches being broken or missing, exposing employees to scalding and/or lacerations during the handling of the containers. Among other methods, one feasible means of abatement is to remove the containers with damaged lids and replace them with serviceable lids.
