Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que estan causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: At the outside of the building, an area where maintain the trailers as storage units: three (3) employees were observed inside the trailer: where the employer did not provide a means of access (stairs). The height from ground to trailer floor level ranged from 46 to 47 1/2 inches. In one of the trailers, the employee used to access using a scissor fiberglass ladder. Among other methods, feasible and acceptable method to correct this hazard is that the employer will provide a means of access, either a fixed ramp where the trailer is at level; place the trailers at ground level; and provide a fixed ladder or movable. Hazard: Employees were exposed to falls. En el exterior del edificio, area en donde mantienen vagones como almacenes: se observo a tres (3) empleados dentro del vagon: patrono no le proveyo un medio de acceso (escalera). La altura desde el suelo al nivel del piso del vagon fluctuaban entre 46 a 47 1/2 pulgadas. En uno de vagones, la empleada para accesar utilizo una escalera en fibra de vidrio tipo tijera. Entre otros metodos, un metodo factible y aceptable para corregir este riesgo es que el patrono les provea un medio de acceso, ya sea una rampa fija en donde el vagon quede a nivel; colocar los vagones a nivel del suelo; proveerle una escalera fija o movible.
