Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to falls from stairs: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que estan causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a caidas desde escaleras: At the warehouse: were observed 13 metal sliding stairs without handrails. Ladders are used by employees to access merchandise. Sometimes the employees have to slide sideways to accommodate or seek the merchandise. Ladders have dimensions of 10 feet 9 inches (129 inches) of long and 1 foot 4 inches (16 inches) of width. The steps have 5 inches of length. Between each step are 10 inches. The ladder has 8 consecutive steps and then there are a clearance of 24 inches. Employees have to use stairs with hands occupied with merchandise. Among other methods, one feasible and acceptable method to correct this hazard is to provide the stairs with attachments where the employee can grab to control the balance of the body. En el almacen: se observaron 13 escaleras en metal corredizas sin pasamanos. Las escaleras son utilizadas por los empleados para accesar mercancia. En ocasiones tienen que deslizarse hacia los lados para acomodar o buscar la mercancia. Las escaleras tienen dimensiones de 10 pies 9 pulgadas (129 pulgadas) de largo y 1 pie 4 pulgadas (16 pulgadas) de ancho. Los escalones miden 5 pulgadas de ancho. Entre cada escalon hay 10 pulgadas. La escalera tiene 8 escalones consecutivos y luego de estos hay un espacio libre de 24 pulgadas. Empleados tienen que usar la escalera con las manos ocupadas con mercancia. Entre otros metodos, un metodo factible y aceptable para corregir este riesgo es proveer las escaleras con aditamentos donde el empleado pueda sostenerse para controlar el balance del cuerpo.
