North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to caught in between and struck-by hazards:
a)melt shop, columns(s) of the VAI Fuchs Electric Arc
Furnace, the method used was insufficient to lockout
gravity on column(s) A, B, and C, which weighed 12 tons
each.
Among other methods, one feasible and acceptable method to
abate this hazard is to effectively lockout/block the
column(s).

North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to caught in between and struck-by hazards:
a)melt shop, Superior Machine Co. did not establish control
of hazardous energy.
Among other methods, one feasible and acceptable method to
abate this hazard is to effectively develop and implement a
hazard control program. This program must consist of the
following elements:
1)Each unique piece of equipment, system or process
shall have detailed procedures developed and
documented for the control of hazardous energy
during servicing or maintenance activities. These
procedures shall be posted or otherwise readily
available for authorized individuals to review and
use. Reference ANSI Z244.1-2003, Section 5.3.1.1 -
Hazardous Energy Control Procedures.
2)When lockout/tagout is not used for tasks that are
not routine, repetitive, and integral to the
production process, or traditional lockout/tagout
prohibits the completion of those tasks, then an
alternative method of control shall be used.
Selection of an alternative control method by the
user shall be based on a risk assessment of the
machine, equipment, or process as specified in
5.4.1. The risk assessment shall take into
consideration that existing safeguards provided
with the machine, equipment or process may need to
be removed or modified to perform a given task. The
alternative method selected shall have detailed
procedures developed and documented for the control
of hazardous energy. Reference ANSI Z244.1-2003,
Section 5.4 - Alternative Methods.
3)When using any engineered safeguard as an element
of an alternative control method, the user shall
use robust industrial quality components,
incorporate control reliable safety control
circuits, consider the effectiveness and failure
modes of the device(s), assess the possible
residual risks, and the possibility that the
safeguard may be defeated/bypassed. Reference ANSI
Z244.1-2003, Section 5.4.3 - Engineered Safeguards.
