North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards created while utilizing an industrial truck to elevate personnel: a)above acid room, an employee was lifted fifteen above ground level in a personnel basket attached to a Hyster E50XL-33 forklift. The personnel basket was not securely attached to the lift. Among other methods, one feasible and acceptable abatement method would be to properly secure the personnel basket to the forks of the lift with chain or other device. Reference: The American Society of Mechanical Engineers (ASME) Safety Standard for Low Lift and High Lift Trucks B56.1.
