Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injury from falling loads and/or lift parts: (a) For the employees operating the 2-cylinder in-ground lifts that did not have identified load ratings in the north and south service shops of Westlie Motor Company, located at 500 South Broadway, Minot, North Dakota. (b) For the employees operating the Forward 4-post lift, Model #125ARO, Serial #084 DI 1191, with a 12,000-pound capacity with oily lock rods in the north service shop of Westlie Motor Company, located at 500 South Broadway, Minot, North Dakota. (c) For the employees operating the Rotary 2-post lifts, Model #SPOA9-200, with a 9,000-pound capacity that were not lowered onto the safety locks in the north service shop of Westlie Motor Company, located at 500 South Broadway, Minot, North Dakota. (d) For the employees operating the Forward 2-post lift, Model #EP012, Serial #185JL11486, with a 12,000-pound capacity that was hoisting a service vehicle equipped with a jib crane, potentially overloading the rear swing arms in the south service shop of Westlie Motor Company, located at 500 South Broadway, Minot, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements of ANSI/ALI ALOIM and/or ANSI B153.1 which includes, among other requirements, the following: 1.Institute a preventive maintenance program according to the manufacturer's specifications. 2.Provide training to employees on proper use and care of the lifts. 3.Ensure all lifts are rated and marked with their load capacity. 4.Schedule and complete all periodic and annual inspections. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement Certification Letter").tion
