Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) Construction site - Employees lifted a Fairbanks Titan series truck
scale by
guide rails welded to the deck; the welds of the rails failed, resulting
in an
employee's right hand being crushed when the scale dropped, on or about
June
15, 2009.
Among other methods, feasible forms of abatement would include following
manufacturer
recommendations and company programs:
1. "Always attach chains to the scale weighbridge."
2. "exercise extreme care when lifting a module assembly", "ensure that
the lifting
chains are equally loaded, secure, and that an angle of greater than 30
degrees
is maintained.
3. Lift a single 35 foot module
4. Consult manufacturer data to determine the weight of the scale prior to
lifting.
5. Adhere to company safety program guidance against working under
suspended
loads
Abatement certification and documentation required within 10 days after
abatement date.  The
certification shall include a statement that abatement is complete, the
date and method of
abatement, and state that employees and their representatives were
informed of this abatement.
Abatement documentation shall include documents demonstrating that
abatement is complete,
such as evidence of the purchase or repair of equipment, photographic or
video evidence of
abatement or other written records.
