Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) Production floor - Employees used a 10 riser mobile ladder stand which
did not settle
to a locked position as a result of improper maintenance of the wheel,
exposing
employees to potential injury from a ladder tip-over, on or about May 18,
2009.
b) Production floor - Employees used a mobile ladder stand that had
damaged legs and
wheels and legs, exposing employees to potential injury from a ladder
tip-over, on or
about May 18, 2009.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method
to correct this hazard is: Comply with the manufacturer's requirements and
ANSI A14.7-1991
for Mobile Ladder Stands and Mobile Ladder Stand Platforms. Section 6.3
requires: "Units that
are damaged or weakened from any cause shall not be used until repairs are
completed. Units
that are damaged subsequent to their receipt, and/or are worn beyond
repair shall be destroyed.
Never climb a damaged ladder stand or ladder."
Abatement certification required within 10 days after abatement date.  The
certification shall
include a statement that abatement is complete, date and method of
abatement, and states
employees and their representatives were informed of this abatement.tives
