General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to both fall and crushing hazards: a) Construction site, Sewer line excavation - An employee was permitted to ride in and work from the bucket of a Hitachi EX270 LC excavator while cleaning debris from a sewer pipe in the excavation, on or about August 11, 2009. ABATEMENT NOTE: Feasible and acceptable means of abatement methods could include but are not limited to: 1. Follow the safe operating procedures set forth in the Operator manual stating "read all warning labels" (applicable label on boom states Keep away from machine during operation", and keep riders off machine). 2. Follow SAE J153 instructions stating "do not allow riders on the machine if there is no designated place for riders" 3. Follow the Construction Industry Manufacturers Association (CIMA) safety manual for Hydraulic Excavators (HE-60-1), which states on page 18 -"Never allow anyone to ride the attachment or the load", page 29 which states "Do not allow personnel to be in pinch points when the machine is in operation", or the revised version, Association of Equipment Manufacturers (AEM) HE03-02, which states on page 20, "never use a bucket for a work platform or personnel carrier". Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
