Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free of recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while using improperly maintained mobile ladder stands. a) Candlewic, Warehouse - On or about August 11, 2009, a 10 riser mobile ladder stand is in use by employees that has damaged parts and is covered in paraffin wax on all treadles creating multiple fall hazards from no less than 7'10" above grade. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is: Comply with the manufacturer's requirements and ANSI A14.7-1991 for Mobile Ladder Stands and Mobile Ladder Stand Platforms. Section 6.3 requires: "Units that are damaged subsequent to their receipt, and/or are worn beyond repair shall be destroyed. Never climb a damaged ladder stand or ladder." Section 7.2.3 reads, "The owner of a unit, or employer having supervisory control of a unit, has the total responsibility for its proper inspection, setup, use, and maintenance." No abatement certification or documentation required.tion

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries due to improperly assembled storage racking systems: a) Candlewic, Warehouse - On or about August 11, 2009, no less than five front cross bars of a steel storage shelving system were not fully secured. Only one of the teardrop stud and keyhole slot connections was partially engaged, exposing employees to the hazard of being crushed by unsecured rack components and stored materials while working in the vicinity of the overhead storage. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement is to ensure the structural integrity of the storage racks is maintained through a program of routine inspections to identify those conditions that require repair and/or replacement of missing or damaged parts in accordance with ANSI MH16.1 - 2004, Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks, section 1.4 Integrity of Rack Installations. No abatement certification or documentation required.tion
