Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing/amputation hazard from unintended activation:
a)  Shop - The foot pedal on the four press brakes were not guarded
against accidental
activation, on or about December 14, 2009.
ABATEMENT NOTE:  Among others, one feasible and acceptable method of
abatement would
be to follow ANSI Standard B11.3.1982 entitled "Safety Requirements for
the Construction,
Care and Use for Machine Tools and Power Press Brakes.", Section 4.2.4.1
Foot Pedal
(mechanical) Activation Prevention.  When a mechanical foot pedal is
furnished with the power
press brake, a means shall be provided for preventing accidental operation
of the power press
brake.
Abatement certification required within 10 days after abatement date.  The
certification shall
include a statement that abatement is complete, date and method of
abatement, and states
employees and their representatives were informed of this abatement.
