Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed injuries from falling and crushing hazards while operating
vehicle mounted
articulating boom aerial lift:
a) Clearfield Road, Bushkill Township - On or about December 9, 2009 the
aerial lift
mounting bolts on the ALTEC LRIII-55 were not inspected and torqued
monthly to
ensure they were providing the engineered amount of restraint, resulting
in the failure
of the lift during a tree trimming operation.
ABATEMENT NOTE: Among other methods of abatement, one feasible and
acceptable method
to correct the hazard is to comply the below listed sections of ANSI 92.2
(2009) Vehicle-
Mounted Elevating and Rotating Aerial Devices and the Altec Maintenance
Manual.
1. Section 8.2.2 Inspection and test "intervals shall be set by the owner
in accordance
with the manufacturer's recommendations"
2. Section 8.2.3 Inspection and tests of, "Items determined by the owner
in accordance
with the manufacturer's recommendations shall be inspected for defects."
3. Section 8.2.4(13) states inspections shall include the "Condition and
tightness of bolts
and other fasteners in accordance with the manufacturer's recommendation.
4. The Maintenance Manual for the ALTEC LRIII-55 dictates specific torque
values in
three locations (located in Section IV - Maintenance) which are to be
completed monthly,
which include the pedestal, platform, and turntable bolts and nuts.
Abatement certification required within 10 days after abatement date.  The
certification shall
include a statement that abatement is complete, date and method of
abatement, and states
employees and their representatives were informed of this abatement.
