Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
are exposed to the hazard of an explosive release of compressed gas and
projectiles as well as
exposure to flammable or explosive gas that results from the shredding of
the pressurized gas
cylinders:
a) Recycle Metal Corporation - Shredder/Conveyor Area: The employer failed
to ensure
that pressurized gas cylinders are removed from the scrap being conveyed
into the
American Pulverizer 60x60 Shredder machine in accordance with the
requirements of the
Compressed Gas Association and the Institute of Scrap Recylcing Industries
on or about
12/28/09.
Abatement certification required within 10 days after abatement date.  The
certification shall
include a statement that abatement is complete, date and method of
abatement, and states
employees and their representatives were informed of this abatement.
ABATEMENT NOTE:  One feasible and acceptable method of abatement would be
to develop
and post written procedures to ensure that proper inspections are
conducted on all incoming
scrap to ensure that hazardous items including compressed gas cylinders do
not enter the
shredder and ensure that employees, who perform these inspections of scrap
materials at various
stages of processing, are trained to properly identify problem cylinders
that have not been
properly decommissioned for destruction as scrap.  Such a procedure should
be developed using
requirements contained in the Compressed Gas Association Pamphlet P-22 and
the Institute of
Scrap Recycling Industries (ISRI) - Safety Reference Manual - Version 1.1.
