Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees from fall hazards
in that employees were using mobile ladder stands with damaged or
defective parts and labels
that had been removed:
a) JCPenney Store 1531, 3rd Floor Warehouse - On or about January 7, 2010,
employees
were using a Rol-Away "Stock Picker" Model SH6WM1 Serial Number 68848
7-riser
mobile ladder stands with missing parts and missing labeling which did not
provide
employees with information relating to maximum safe load rating
potentially exposing
employees to fall hazards no less than 70 inches above grade.
b) JCPenney Store 1531, Chrismas Aisle - On or about January 7, 2010,
employees were
using a Colson Model 31256 7-riser mobile ladder stand with damaged
treadles,
missing
parts and labels indicating the maximum load rating.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method
to correct this hazard is: Comply with the manufacturer's requirements and
ANSI A14.7-1991
for Mobile Ladder Stands and Mobile Ladder Stand Platforms. Section 6.3
requires: "Units that
are damaged subsequent to their receipt, and/or are worn beyond repair
shall be destroyed.
Never climb a damaged ladder stand or ladder." Section 7.2.1, Item 3
states, "Each unit shall
be marked with: Maximum rated load." Section 7.2.3 reads, "The owner of a
unit, or employer
having supervisory control of a unit, has the total responsibility for its
proper inspection, setup,
use, and maintenance."
