Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees from fall hazards
in that employees were using mobile ladder stands with damaged parts:
a) Falls Manufacturing, Stock Area - On or about April 20, 2010, employees
were using
two 8-riser mobile ladder stands with missing and damaged parts exposing
employees to
fall hazards no less than 75 inches above grade.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method
to correct this hazard is: Comply with the manufacturer's requirements and
ANSI A14.7-1991
for Mobile Ladder Stands and Mobile Ladder Stand Platforms. Section 6.3
requires: "Units that
are damaged subsequent to their receipt, and/or are worn beyond repair
shall be destroyed.
Never climb a damaged ladder stand or ladder." Section 7.2.3 reads, "The
owner
of a unit, or
employer having supervisory control of a unit, has the total
responsibility for its proper
inspection, setup, use, and maintenance."
