Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being thrown from and hit by the Beuthling Self Propelled Vibratory Compactor: location: 485 Washington Ave. on or about: 4/28/09 a) A second employee was riding on the water tank of the Beuthling Self Propelled Vibratory Compactor 2-ton, B200. The compactor is designed for only one rider. Among other methods, one feasible and acceptable method to correct this hazard is: Follow the instruction in the Construction Industry Manufacturers Association (CIMA) Roller Compactor Safety Manual, "NEVER allow other personnel to ride on your machine unless appropriate seating is provided and then only if authorized to do so." location: 485 Washington Ave. on or about: 4/28/09 b) The main drive chain of the Beuthling Self Propelled Vibratory Compactor 2-ton, B200 was not checked weekly for link wear, or damage. Among other methods, one feasible and acceptable method to correct this hazard is: Follow the instructions in the owner's manual sent to CSHO by the manufacturer which states "Weekly check the main drive chain for link wear, or damage." or the instructions in the owner's manual given to CSHO by Arrow Blacktop which states "Check main drive chain weekly". NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
