Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falling 7 feet 2.5 inches from a unsecured and unprotected wooden pallet of paver stones and the mast of the forklift or being caught crushed between the mast and the load. On or about 10/20/09 Location: 175 Saw Mill River Road, Elmsford, NY 10523 a) An employee was raised to a height 7 feet 2.5 inches by a Toyota model 7FDU32 forklift truck, serial number 62780 while on a bundled wooden pallet of paver stones which was held up by the forks. The employee stood on the forklift mast to stabilize the load and was exposed to being crushed between the mast and the load or falling from the mast. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS... Follow the manufactures warning stating never to lift or carry riders on forks. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
