Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration, or other fire hazard from the improper design and location of the air material separators: a) Converting Department - The enclosureless dust collectors on the 828 Ward Flexofolder gluer did not have explosion protection systems and were located inside the building. (b) Roll Room - The FARR GS12L Gold Series dust collector used with the corrugator did not have explosion protection systems and was located inside the building. (c) The FARR GS12L Gold Series dust collector was not provided with an isolation device to prevent deflagration propagation from the air material separator upstream into the work area. (d) Converting and Corrugator Departments - Vacuum cleaners used to clean dust daily by employees are not listed for use in Class II hazardous locations. Among other methods, feasible abatement to correct this hazard is to: perform a process hazard analysis (PHA) of the processes and the facility per the intent of NFPA 654 Section 4.2.1, 2006 - Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing and Handling of Combustible Particulate Solids. Relocate the dust collectors outside the building or install engineering controls such as suppression, inerting, or venting in accordance with the requirements of the National Fire Protection Association (NFPA) 654, Section 7.13.1.1.1 and FM Global Property Loss Prevention Data Sheet 7-73 (January, 2008). Install an isolation device per NFPA 654, Section 7.1.5.1. Provide vacuum cleaners listed for use in Class II hazardous locations or a pipe suction system with remotely located exhauster and dust collector per NFPA 654, Section 8.2.3.1. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
