Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burn injuries from scalding water: a)Kitchen, Pressure Fryer Area: Two employees were injured when the manufacturer's instructions were not followed and water was heated inside a Henny Penny Gas Pressure Fryer (Model 690), on or about 5/16/09. NOTE: Among other feasible and acceptable methods to correct this hazard include but are not limited to: 1.Develop and document and post proper procedures for cleaning the Henny Penny Fryer and provide employee training on those procedures. 2.Provide training to employees concerning the manufacturer's instructions for the Henny Penny Fryer including safety warnings such as not heating water in the fryer and ensure comprehension of the hazards associated with operating and cleaning the Fryer. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
