Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an operator was exposed to the hazard of being flipped while operating a JLG Rough Terrain Forklift: Employees were using a JLG Rough Terrain Forklift, Model Number G10-55A, to hoist up to approximately 2,700 pound loads, which exposed the operator to a hazard of overturning the forklift; this action was against manufacturers' recommendations (p.1-7 - "Never suspend load from forks or other parts of carriage"). Among other methods, one feasible and acceptable method to abate this hazard is for the employer to use a crane to lift the precast members into place. There is no abatement certification or documentation required for this item.
