Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that a
passenger was exposed to the hazard of falling from the equipment.
At the repaving jobsite in Ina Illinois, two supervisors were allowed to
ride in an Ingersoll-
Rand ST-80 Tandem Roller while conducting training with an inexperienced
operator.  The
Ingersoll-Rand ST-80 was operated without an approved location for a
passenger to ride on
the machine.
Among other methods, one feasible and acceptable method to correct the
hazard is to ensure
that supervisors conduct training from a safe location near the machine.
ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE
WITH THE REQUIREMENTS OF 29 CFR 1903.19(c).S
