Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing death or serious physical harm to employees in that an
employee was
exposed to a fall due equipment failure of a aerial lift being used to
lift a 200 to 300 pound
evaporator.
An employee was using a Genie, model number HP-9K-25810-P/N50676, as a
crane to lift a
200 to 300 pound condensor from the approximately 20 foot high roof.   The
employee in
the basket of the lift was exposed to ejection from the basket, and a
fall: this action was
against manufacturers' recommendations (Genie's); and consensus standard
ANSI A92.5
2006 Section 7 (20) -The aerial platform shall not be used as a crane.
Among other methods, or feasible and acceptable method to abate this
hazard is for the
employer to use a crane to lift the evaporator from the roof of the
building.
ABATEMENT DOCUMENTATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE
WITH THE REQUIREMENTS OF 29 CFR 1903.19(d).
