Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish a place of employment, which was free from recognized hazards that
was causing or
likely to cause death or serious physical harm to employees in that
employees were exposed to
struck by and crush hazards:
Employees using the McDonald Services, Inc. MSI Balers Vertical Series
(Model Number
VB6030 11.5, Serial Number 481 DM) baler were exposed to struck by and
crush hazards. The
employer failed to inspect and maintain the safety gate.  The employer did
not provide sufficient
training for employees assigned to maintain and operate the baler.
Among other methods, the following is a feasible and acceptable method to
correct this hazard.
Follow ANSI Z245.5-1997, "American National Standard for Equipment
Technology and
Operations for Wastes and Recyclable Materials - Baling Equipment - Safety
Requirements" for
established safety requirements with respect to the maintenance and
operation of the baler.
Follow manufacturer direction and inspect the baler for periodic
maintenance indicators.
Abatement certification is required for this item in accordance with the
requirements of 29 CFR
1903.19(c).s
