Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by an overloaded pedestal crane. On or about 11/18/09, while the LC 400-200 pedestal lattice boom crane, SN LC400200X609 was moving a 30 Ton concrete test block from the flat bed trailer of an 18 wheeler to the ground, employees were exposed to being struck by the crane as it became overloaded due to residual stress in the weld/HAZ connecting the cab to the pedestal structure. One feasible and used abatement method for correcting this hazard, among others, is to, comply with American Welding Society (AWS D1.1/D1.1M:2008) for Structural Welding Code -- Steel, paragraphs 3.14 and 5.8 regarding Postweld Heat Treatment of the weld connecting the cab to the pedestal of the crane.
