Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recog nized hazards that were causing or likely to cause death or serious physical har m to employees in that employees were exposed to a struck-by hazard: Employee(s) were exposed to a struck-by hazard when assigned to perform flagging/spotting o perations without wearing a high visibility/reflective vest. Among other methods , feasible and acceptable methods to correct this hazard is to: 1) Develop a wri tten spotting/flagging policy. 2) Ensure employees are trained and understand th e duties of flagging/spotting. 3) Ensure that employees wear high visibility ves t when performing flagging/spotting operations. 4) Implement an effective discip linary program to ensure compliance with the flagging/spotting policy.
