General-duty citation text

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized
hazards that were causing or likely to cause death or serious physical
harm to employees in
that employees were exposed to the hazard of: chemical exposure to their
eyes or skin.
The employer failed to test the flow rate of 75 of their combination
eyewash/shower
emergency facilities on an annual basis as required by ANSI Z358.1 (2004).
This violation
was observed on or about September 22, 2010 when the employer stated they
did not conduct
annual flow tests on any of numerous the eyewashes located throughout the
plant.  Not
having use of a properly adjusted combination eyewash/shower emergency
facilities in the
event that corrosive chemicals get into their eyes or onto their
skin/clothing could lead to
chemical burns and blindness.
Pursuant to 29 C. F. R. 1903.19, within ten (10) calendar days of the
abatement date, the
employer must submit documentation that it is in compliance with the
standard, including
describing the steps it is taking to ensure that all eyewash and shower
facilities are flow
tested annually.
One method of abatement, among others, would be to add flow testing to the
regular PM
program.
