5(a)(1)

Deleted Serious Gravity 10 1 instance 5 exposed
Issued
Abate by
Penalty
Initial $1500.00 · Current $1500.00
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
On or about May 12, 2009, and times thereto, employees of C & C Welding,
Inc., were
exposed to an explosion hazard as they worked to install a gauge pole in
the 67,000
barrel unleaded fuel tank #1303. An isolation/Blind List was created on
May 07, 2009,
by a TEPPCO employee to ensure that each contractor associated with the
cleaning or
construction work to be performed in tank #1303 could verify and perform
lock out tag
out procedures on all identified sources of potential hazardous materials.
The employer
did not verify that the Isolation/Blind List was accurate and did not
provide locks to the
areas prescribed by the list which allowed the employees to access the
explosion hazard
area without knowing if the confined space was adequately locked out.
One feasible means of abatement would be to implicitly follow the already
established
and accepted Work Orders, Job Plans and Safety Policy Manuals. These
documents give
adequate instruction of how to mitigate these hazards and to ensure a safe
work place.

Required
Confined Space the employer is required to confirm that the pre-entry
atmospheric testing
has been conducted and that the atmosphere is sufficient, and that space
is safe for
occupancy. The employer did not confirm the results of the pre-entry
atmospheric test
and therefore allowed the employees to enter a potentially explosive
atmosphere.

at the entrance
of the confined space any time an employee enters the space. The employer
did not
ensure that the attendant remained at the confined space entrance whenever
an employee
was inside. Not having an attendant at the designated location would
prevent the exposed
employees from promptly receiving emergency help should a hazardous
condition present
itself thus exposing them to an explosion hazard.
One feasible means of abatement would be to implicitly follow the already
established

Other-than-serious Gravity 10 1 instance 5 exposed

Confined Space
Entry Permit available to all entrants and no one shall be allowed entry
into the confined
space without first having his name placed on the authorized entry list.
The permit found
for this project was missing many key elements such as: the authorized
entrants' names
were not present; the attendant's name was not present; the entry
supervisor was not
designated by name; the entry supervisor did not sign the permit; and the
communications procedures were not in place. Any of these missing
elements could
place the employees in a situation where an emergency crew would not know
who was
in the confined space in the event of an emergency which would further
expose the
employees to the explosion hazard.
One feasible means of abatement would be to implicitly follow the already
established
and accepted Work Orders, Job Plans and Safety Policy Manuals. These
documents give
adequate instruction of how to mitigate these hazards and to ensure a safe
work place.
