Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. (a)Date of Violation:09/16/09 Location:Construction Yard Equipment:A Gradall Material Lift, Model: #S3409-45, Serial: #0644629 Condition:An operator was hoisting personnel in a homemade work platform with the material lift that was not designed by the manufacturer to do so. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use power equipment and work platforms that are designed and approved to safely lift personnel.
