Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicular traffic: a) For employees receiving donated goods at the front of the building and assisting customers loading large items at the side of the building located at 410 N. Indiana Ave in Englewood (FL), as observed on or about Feb 13, 2009. Part of the problem is that parking spaces in the front of the building prevents delivering vehicles from safely pulling into the delivery area. This forces employees to go into the flow of traffic to receive donated goods. Feasible and acceptable abatement methods, among others, to correct this hazard 1.eliminating parking at the front of the building; 2.allowing delivery and pickup only at the rear of the building away from moving vehicles; and, 3.providing and requiring employees to wear high-visibility vests.
