North Carolina General Statute 95-0129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: a)establishment, mixing and recycling areas - the work tasks, including, but not limited to, scooping, dumping, mixing, and sweeping combustible dust, were not properly contained, nor properly handled. The area contained at least one-sixteenth inch of combustible dust (Polypropylene Resin and Resin dust) or greater over 25of the horizontal surfaces of equipment, floor, and the ventilation system duct work. There were various deficiencies in the attempt to control the combustible dust including, but not limited to, the following: the employer's housekeeping program was not effective in eliminating accumulated combustible dust on surfaces in the mixing area, ventilation system duct work, and baghouses, documentation and recordkeeping of air volume, air velocity, and equipment bonding and grounding was not available, including risk evaluation to determine the need of an fire detection system within the duct work or that the automatic sprinkler provided was acceptable, and electrical equipment was not appropriate for classified areas. The employer did not have a written Standing Operational Procedures (SOP) for the cleaning of bag house filters. REFERENCE: Combustible Dust Explosion Prevention Program CPL 03-00-008, and Standard for the Prevention of Fire and Dust Explosions from Manufacturing, Processing, and Handling of Combustible Particulate Solids NFPA 654. NOTE: Among other methods of abatement, one feasible and acceptable method to correct these hazards would be to follow the guidelines established in the Standard for the Prevention of Fire and Dust Explosions from Manufacturing, Processing, and Handling of Combustible Particulate Solids NFPA 654.
