Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to serious burns from potential dust deflagration,
explosion, or
other fire hazards as the result of the improper design and maintenance of
the dust collection
systems:
Paint it the Truth Decorating, Inc., Glenview, IL: The Grizzly Industrial,
Inc. Model G0441
3 HP cyclone dust collector was not equipped or used with the following.
(a) A means of tramp metal protection was not provided to keep any
unwanted metal
fragments out of the air-material separators associated with the wood dust
conveying process.
(b) A means of static charge dissipation, such as bonding or grounding,
was
not provided
between the air-material separators and pieces of equipment which were
connected by
flexible non-metallic duct work on machinery such as, the approximately 6
feet of PVC hose
connected to the dust collector system. The movable exhaust hose "elephant
trunk" was used
to vacuum the excess dust off the sanding and woodworking equipment.
(c) Flexible non-metallic duct was installed on the dust collection
system, approximately 6
feet of PVC hose was connected to the dust collector system. The movable
exhaust hose
"elephant trunk" was used to vacuum the excess dust off the sanding and
woodworking
equipment.
(d) A spark detection system with high speed abort gate or extinguishment
capability was not
installed downstream of the last material entry points and upstream of the
air-material
separators. The Grizzly Industrial, Inc. Model G0441 3 HP cyclone dust
collector was
connected to machinery having an association with producing sparks,
including table saw and
jointer without a spark detection system with high speed abort gate.
(e) Deflagration isolation or suppression systems were not provided for
the inlet (dirty air)
sides of the air-material separators.
(f) A high-speed abort gate operating in conjunction with a spark
detection system was not
provided on the return air (outlet) sides of each air material separator
in order to intercept
and divert any burning material to atmosphere before re-entering the
facility.
(g) The woodworking room in the shop area - The Grizzly Industrial, Inc.
Model G0441 3
HP cyclone dust collector was not equipped with an explosion prevention
system and was
located inside the facility.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to comply with the National Fire Protection Association (NFPA) 664
"Prevention for Fires
and Explosions in Wood Processing and Woodworking Facilities" (2007)
including, but not
limited to:
Install tramp metal protection to in accordance with NFPA 664 Section
7.12.2.
Install static charge dissipation equipment on ductwork such as grounding
and bonding
accordance with NFPA 664 Section 8.2.2.2.1.8.
Replace all non-metallic ductwork with metallic ductwork in accordance
with NFPA 664
Section 8.2.2.2.1.1.
Install explosion prevention systems which may include deflagration
isolation device, to
prevent explosion and deflagration venting, venting to a safe location
outside, in accordance
with NFPA 69 "Standard on Explosion Prevention System," 2008 edition, NFPA
68
"Standard on Explosion Protection by Deflagration Venting," 2007 edition.
Locate dust collectors outside of building according to Section
8.2.2.5.1.4 of NFPA 664.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this
violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET),
and in addition, documentation may include, but is not limited to,
evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement or
other written records.
