Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being crushed by moving buckets of earth moving equipment:
a)  Jobsite:  In the course of performing debris removal and/or other
material handling
operations, employees were exposed to being struck and crushed by the
loader bucket a
John Deere Model 710C backhoe loader (serial number T0710CD755562) which
was
being used to lift, transport, and sort the debris.  On or about 3/18/09.
Abatement Note
Among others, a feasible and useful method to eliminate or to materially
reduce this
hazard would be to comply with the Equipment Manufacturers Institute
(formerly Farm
and Industrial Equipment Institute) Loader/Backhoe Safety Manual For
Operators and
Mechanics, and be sure that the operating area is cleared of all persons.
NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF
ABATEMENT FOR THIS ITEM.  FAILURE TO COMPLY MAY RESULT IN AN
ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
