Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing, or likely to cause, death or serious physical harm to
employees in that employees
were exposed to struck-by hazards by falling materials from unapproved
attachments:
The employer permits the use of attachments to powered industrial trucks
which
have not been approved by the manufacturer of the powered industrial
truck. This
violation occurred on or about April 6, 2009, at this drilling rig
location in Pharr,
Texas, where employee(s), were using a fork attachment which was not
approved
for use by the manufacturer of a JLG/Lull 944E-42 powered industrial
truck.
The employees had been provided the fork attachment to assist in the
lifting of
two sets of drill collar slips to perform general maintenance. The fork
attachment
became detached from the forks and struck an employee.
Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the date of
this
citation, the employer must submit documentation showing that it is in
compliance
with the standard, including describing the steps that it is taking to
ensure
attachments provided for employee use are approved by the manufacturer of
the
powered industrial truck in use and employees are instructed in its use and
installation and can demonstrate their ability to use the lifter.
Some feasible and acceptable methods of abatement are to:
a.Follow the manufacturers recommendation to only use approved
attachments which are marketed by JLG that are available for the
particular powered industrial truck.
b.Comply with ANSI/ASME B30.20-1985 and Addenda 1987, 1988 and
1989 standards for Below the Hook Lifting Devices, 20-1.6: "Operators
must be instructed in use of the device by a designated person and
demonstrate the ability to use the lifter as instructed before assuming
responsibility for using it."
