Title 40.1-51.1(a) Code of Virginia: The employer, Merrifield Garden Center, did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious bodily harm to employees. On April 7, 2009, at 6895 Wellington Road, Gainesville, Virginia, employees of Merrifield Garden Center utilized a 12' Werner stepladder to gain access to the top of a sea crate that measured approximately 9' 6" in height. While the ladder was in use by employees, it was closed and leaning against the sea crate, exposing the employees to fall hazards. One feasible and acceptable abatement method, among others, to correct this hazard is for the employer to use the ladder in accordance with American National Standards Institute (ANSI) A14.5-1982, Safety Requirements for Portable Reinforced Plastic Ladders, Section 9.3.1.2 which provides as follows: "Self-supporting ladders shall not be used as single ladders or in the partially closed position."
