HAR 12-60-2(a)(3) was violated because:
The employer did not ensure that a moat requiring entry and egress by
Animal Caretakers,
was free of or minimized for slipping hazards.  The concrete exhibit
housing the Elephants
contained a moat six feet below grade at a forty five degree angle.
Caretakers had no means
of a brace or other engineering control to assist them while traversing up
and down this
incline to perform work.  The risk of serious bodily injury or impairment
is greater when no
engineering or design method is provided to assist the Animal Keepers in
performing their
duties.
12-60-2(a)(3) states "Every employer shall provide safe work places and
practices by
elimination or reducing of existing or potential hazards.  Elimination of
existing or potential
hazards by design, process substitution, or other appropriate methods is
preferred because it
eliminates the need for further employee protection.  When elimination is
not
feasible,
reduction of existing or potential or administrative controls, isolation,
or guarding, shall be
promptly used.  When these methods are inadequate to reach acceptable
levels, personal
protective equipment shall be provided and used."
