Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees in that employees were exposed to the hazards of falling due to an unplanned collapse. a/ At the job site, prior written approval from the original fork truck manufacturer was not obtained before authorizing the modification to a CASE 585E 4 X 4 Fork Truck, no m/n or s/n. The modification was in the form of a home-made personnel platform that was attached to the forks of the truck and used by employee(s) to install wooden soffit and fascia. One method of abatement is to obtain written approval from the manufacturer as required by ANSI B56.1- 1969, paragraph 4.2.1. DISCLAIMER: a/ The employer is not limited to the abatement method(s) suggested by OSHA. b/ The employer is responsible for selecting and implementing an effective abatement method. ABATEMENT CERTIFICATION AND ABATEMENT VERIFICATION ARE REQUIRED FOR THIS VIOLATION.ON
