Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about August 5, 2009, and at times prior thereto, the employer did not ensure that employees wore seat belts while operating a Terek TX760B Backhoe/loader, exposing them to the hazards of being struck by or crushed by the vehicle. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees are wearing seat belts at all times while operating the backhoe/loader, as required by the operator's manual for the Terex TX760B.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about August 5, 2009, and at times prior thereto, at the facility located on Interstate 124, 2-1/2 miles off Highway 9, Center Ridge, Arkansas, the employer allowed employees to ride as passengers on the vehicle, exposing them to being thrown from, struck by and/or crushed by the Terex Model 760B backhoe/loader. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that no one is allowed to ride on the vehicle except the operator as required by the Terex Model 760B operator's manual.
