North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)jobsite, building #10- employee exposed to fall hazard of approximately 20 feet due to being lifted up on the forks of a rough terrain forklift. One feasible and acceptable method of abatement, among others, to correct this hazard is for the employer to follow the procedures in the ASME/ANSI B56.6-2002 Safety Standard For Rough Terrain Forklift Trucks.
