Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that powered industrial truck operators were exposed to falling, caught between or under, and struck-by hazards; and crushing injuries and amputations: a) On or about 03/31/2009, at 7889 NW 98th Street, in Hialeah, Florida, an employee was operating a Komatsu powered industrial truck with no seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a seat belt assembly and require the seat belt to be worn by the operator. b) On or about 03/31/2009, at 7889 NW 98th Street, in Hialeah, Florida, an employee was operating a Clark powered industrial truck with no seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a seat belt assembly and require the seat belt to be worn by the operator. PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
