Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: On or about March 27th, 2009 at the Super Six Farms, employees were exposed to the hazard of being struck-by or crushed by farm equipment while crew members were picking tomatoes in the field. Among other methods of abatement, a feasible and acceptable method to correct this hazard is: a. Prohibit employees from working near the farm equipment. b. Ensure that all crew members are in a safe place before starting or moving farm equipment. c. Train employees and enforce work rules.
