Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees riding unrestrained in a
pick-up truck's cargo area
with unsecured cargo were exposed to struck-by and fall hazards:
On or about 4/22/2009, at 8460 Church Road, in Felda, Florida, employees
were permitted to
stand and ride in a blue Chevrolet pick-up truck's cargo area with
unsecured nested plastic
boxes.
Among other methods of abatements, one feasible and useful method to
correct the hazard is for
the employer to develop a policy prohibiting helpers from riding
unrestrained in a pick-up
truck's cargo area.
PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS
VIOLATION.
