Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
to each of his employees employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to:
a.At the yard area, a means of fall protection was not provided for an
employee who perform repairs on top of intermodal containers, exposing
the employee to a fall hazard of 8'-0", on or about 4/27/2009.
Among other methods, one feasible and acceptable means to correct the
hazard is to prohibit employees from conducting work from top of the
intermodal containers without the use of a fall protection system.
Note:Certification of abatement must be submitted for this citation item
as required by 29 CFR 1903.19(c).

a.At the container repair area, an employee used a portable grinder
(Dewalt,
Model D28494) that lacked a guard which exposed the employee to struck
by and caught by hazards, on or about 4/28/2009.
Among other methods, one feasible and acceptable means to correct the
hazard is to prohibit employees from using the equipment without a guard,
unless work to be performed offers the necessary protection.

as required by 29 CFR 1903.19(c).
