Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 6/11/2009, at 1509 North View Drive, Miami Beach, Florida, an employee was struck-by the shovel of a Bobcat while retrieving plants from the rear end of the "Box" truck, thus striking his lower right leg resulting in mulitple open fractures. Among other methods, one feasible and acceptable abatement method to correct this hazard is to prohibit employees to operate heavy equipment while in close proximity of other employees. NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
