Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to fall hazards
by not securing the
ladder and using a defective ladder:
On or about 6/3/2009, employees were using an extension ladder that was
missing the safety
cleats and was not secured.
Among other methods of abatement, one feasible and acceptable means of
abatement method to
correct this hazard is to ensure that the ladder base shall be placed with
a secure footing on a
firm, level support surface; ladder levelers may be used to achieve equal
rail support on uneven
surfaces; devices such as shoes, spurs, spikes, combinations, thereof, or
similar devices of
substantial design should be installed where required for slip resistance
and
bearing area and
ladders are inspected daily and before each use.
