Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush-by hazards: On or about 7/30/09, at the Altira Inc. north building, the Mitsubishi power industrial truck were operated without a seatbelt. Among other methods, a feasible and acceptable means of abatement is to follow the recommendations of the manufacturer that states that the lift truck operator must wear a seat belt during operation. A seat belt assembly must be installed as referenced by ASME ANSI B56.1.
